Scope and Interpretation of the User Agreement
1.1. The User Agreement applies to all legal relations between the User and the Financial intermediary services Provider (if applicable according to the terms) and between the User and the Payment Service Provider.
1.2. Each of the following legal entities is hereinafter referred to as Service Provider:
1.2.1. Financial intermediation services: Company name: WESTINGPAY, registration number: 15083017, Address: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ
1.2.2. WESTINGPAY. Nature of work of service (SIC) 64999 - Financial intermediation WESTINGPAY Financial intermediation transactions, E-wallet and financial services.
1.3. Each clause of this User Agreement shall apply mutatis mutandis to the Payment Service Provider and the Virtual Currency Service Provider, taking into account the fact that each of them provides only part of the Services provided by the Platform and depends on the User's place of residence. Services may be offered by different legal entities.
1.4. Services (hereinafter referred to as Services) means an environment offer to the User and the ability to use the Virtual Currency Service and the Payment Service, taking into account:
1.5. Financial intermediation Unit Service includes:
1.5.1. E-Wallet means a virtual currency wallet service, namely a service where keys are generated for the User and where the User's encrypted keys are kept, which can be used for the purpose of storing, storing and transferring virtual currencies;
1.5.2. The Platform provides Virtual Currency Service (crypto e-wallet and crypto exchange services) only regarding BTC, USDT, ETH, BCH, LTC, DASH, XRP, DOGE, TRX virtual currencies.
1.6. For EEA country users, the Virtual Currency Service is provided by the Virtual Currency Service Provider.
1.7. For users from countries outside the EEA, the Virtual Currency Service is provided by the Payment Service Provider.
1.8. Payment Service means a service within the framework of which the account is opened for the User. The currency held by the User in the account opened and the User has the opportunity to carry out payment transactions and receive funds from another payment account(s) opened with it, including the transfer of his own currency to another payment account(s) opened with the Payment Service Provider. Withdrawal of funds to the User's bank account by the Payment Service Provider or withdrawal by any other method provided by the Payment Service Provider (e.g. to payment account(s) opened with another payment service provider), foreign exchange service,
1.8.1. The financial intermediation Service is provided solely by the Payment Service Provider.
1.8.2. The Platform provides Payment Services and Money transfers between WestinPay accounts only in the following currencies: EUR, USD, GBP, RUB.
1.9. Virtual currency means a value represented in digital form which can be transferred, stored or traded digitally and which natural persons accept as means of payment but which is not legal tender of any country or fund within the meaning of Article 4(25) of Directive 2002/65/EC , Decision (EU) 2015/2366 of the European Parliament and of the Council on payment services in the internal market amending Directives 2009/110/EC and 2013/36/EU and Regulation (EU) No 1093/2010 and repeal of Directive 2007/64/EC (OJ L 337, 23.12.2015, pp. 35-127) or a payment transaction within the scope of paragraphs (k) and (l) of Article 3 of the same Directive.
1.10. In addition to the User Agreement, the relations between the User and the Service Provider are subject to the applicable legislation of the United Kingdom, the Service Provider's Privacy Policy, the Service Provider's price list for the relevant use (hereinafter - Price List). service, detailed terms and conditions of the service, tutorials and established good practices, if the User is informed about them.
1.11. The fact that any provision of the User Agreement is contrary to the provisions of the law and therefore invalid does not generally affect the validity of the other provisions of the User Agreement.
1.12. All information exchange and communication between the User and the Service Provider exceeds English, unless another language is used in accordance with the agreement between the User and the Service Provider.
